ship that sailed the waters. it's evidence a growing proble problem. tonight a proposed change in course to deal with it. good evening i'm dan. we begin tonight with plan to make whales less vulnerable especially being struck by ships. allen is live tonight at christy field. you spoke with someone in the shipping industry. what are they sayin saying. >>reporter: it's interesting to know that they just spotted 5 hump back whale feeding in the shipping lanes today. but it is important to knee this is just a recommendation being administered by the national ocean administration atmospheric administration. theyre asking ships to voluntarily slow down to continue knot as they approach the golden gate bridge. and here is why. noaa says too many endangered whale suffering ship strike in the shipping lanes that lead into san francisco bay. most recent strike on june 21 when it is believed this whale washed ashore with visible strike from a ship propeller. he experts

from noaa performed the autopsy and the vertebra was cleanly severed by a large blade. this summer a large number of whales spot theed outside the golden gate bridge feeding on the huge swarm of criminal seems to be closer to shore this year. while the slow down recommendation is voluntary noaa says it is getting cooperation from the shipping industry. >> obviously it's probably counter to their business interest to show down. they have schedules to make. but the ships the crew on the ship also understand the whales are magnificent app mall and nobody wants to hit them. so i think if they can see a real nexus between alaska that is might be required of them and benefit to the whale population then we hope for success. >> we have had great luck with the shipping industry this yea year. they have been involved over a year with us in coming one solutions and they actually were part of developing these recommendations.

>>reporter: noaa will monitor the ships but currently working with the international maritime organization to modify the shipping lanes and move them further offshore. while there is no research to show it would work, they also want to establish a slow lane. recen recently the shipping industry agreed to have trained whale spotters aboard who will help send out warnings to other ships. so the announcement today that it is recommending all ships coming in to the golden gate and in san francisco bay slow down to continue knot. we have more on that tonight on 7 news at 1 11:00. reporting live in san francisco, back to you dan. >> okay thanks a lot. >> 20-year-old santa rosa man drowned in the russian river today. the fifth person to die in the river this summer. investigators say the man was swim with 2 friends near sunset beach not far from forestville when he began splashing and went under. sheriff's office says he was a good swimmer and no drug or alcohol was involved

here. deputy say what make this is unusual was that sunset beach is really a tranquil spo spot. the drowning today happened about a mile downstream from steel head beach where 13-year-old san francisco boy drowned on sunda sunday. search continues this evening for a man from san rafael after he did not return from a day of hiking in sequoia national park south of fresno. national park service says that 31-year-old tom hang was last seen around 1 on sunday afternoon near the 13,000 foot mark on mount langley. see the picture there. i'll describe him for you. hang has short black hair. 6 feet tall. 165 pounds. he was last seen wearing a white t-shirt. tan full brim hat and sunglasses. probably the hat you are wearing there and sunglasses you see him wearing. 20 people and helicopter are currently looking for him. as they hope to bring him home. the scandal over money from california of park system takes a new twist tonight. several state agency are now fighting

over millions of surplus dollars. money that was kept secret for more than a decade. 7 news capitol correspondent annette is in sacramento. >>reporter: california state park system is still reeling from friday scandal when administrators revealed 54 million dollars had been found sitting in an account undetected for the last 12 years. supporters just spent the last year raising money to save 70 park from closing due to budget cuts. the surplus now is touching off a money grab because parks doesn't necessarily get to keep the money. >> no department gets to keep technically gets to keep any of this money. this is taxpayer funds. and ultimately it is the decision of the legislature how the money is to be, how the money is to be spent. >>reporter: about 33 and half million dollars is in the off highway trust fund which is not supposed to be spent on anything else but the legislature is known to the raid all accounts no matter what it is for. the other 20

plus million could be reallocated for any purpose. supporters say park should get to keep the stash because some locations only have enough could nations to stay open for a few more weeks. plus all 2 78 parks could use some help. >> department of park has been cut on state level for the last 30 years. it is basically operating on a bare bone budge budget. there is a backlog of maintenance work of 1.3 billion dollars and they should be able to keep the money. >>reporter: but every year during the great recession state program had to endure deep budget cuts. >> haven't used it in 12 years it should go to other service that is received the most cuts recently like the welfare service and child care. >>reporter: college students have seen tuition sky rocket say don't forget about them. >> why spend all the 54 million dollars on the park when you can do it separately. put some in the park. put some of it maybe for hear for financial aid. >>reporter: governor brown office hopes lawmakers will

agree to use some of the surplus for parks. but democratic leaders have always said they restore social services whenever there was extra money. in sacramento, abc 7 news. surplus money already having an effect in marin county. officials there have a tax measure in the pipeline to support park. latest information from the state marin county is revising that plan and will talk about it tomorrow. top deputy of former san francisco sheriff mirkarimi has been arrested on assault charges for alleged domestic violence incident. lieutenant vincent was detained last thursday for dispute at a gold gym on market street. police would only say the victim is someone vincent had a personal relationship with. he's openly gay and feature entered this 2009 documentary. he's also charged with false imprisonmen imprisonment. he has been placed on administrative leave. second man accused of killing a father and his 2 sons

in san francisco will not be charged as the trigger man. that deadly shooting claimed 3 members of the baloney family in apparent case of mistaken identity. carolyn tile we are who prosecutors are now going after. >> reyes was arraigned today on several charges. including 3 counts of first degree murder in connection with the fatal shooting of 48-year-old anthony baloney and 2 of his sons back in 2008. but reyes not accused of firing the shots that killed them. an alleged mf 13 gang associate ramos already convicted and is serving 3 life sentences without the possibility of parole. >> all the hate concentrated on ed when he went to trial so they got the scapegoat. >>reporter: during the trail and our exclusive jail house interview ramos insisted he was just driving the car. that reyes pulled the trigger. but the surviving baloney son

testified he saw only one person. ramos. >> that's awfully interesting sint. interesting they didn't come across mr. reyes until they were done ramos trial nishtion fact his son disappeared from san francisco after the murders and was just recently arrested in north carolina. san francisco district attorney george says bringing the 31-year-old here to face trial is just a continuation of the investigation process. >> there have been rumors and information that mr. reyes was in the car from very early on. we needed corroborating information. we needed evidence that would give us the ability to go in front of a jury and beyond reason doubt show that mr. reyes was part of this murders. we have that information today. >>reporter: reyes due back in court august 22. ramos is at san quentin evaluated before he's transferred to a permanent prison home. his attorney says

she's investigating what impact reyes arrest could have on her client case but frankly she doesn't think it changes anything. in the newsroom, carolyn tyler, abc 7 news. moving on to second business news. apple posted jump in revenue this quarter but still didn't mean analyst expectation. the 23 percent represents apple smallest increase in years. in both revenue and net income. still not bad. equates to 35 billion dollars this quarter after all. analyst expected 37 and half million i don't know. experts say the drop in revenue is due to drop in prices for apple product. apple shares fell 35 dollars or 5.8% of the valley on this news. mean time era of tax-free shopping on line may coming to an end. congress is working on bipartisan bill by bay area representative that many are saying could pass. but it is an issue that continues to divide silicon valley. here's

the bay area. center of high pressure offshore with winds flowing towards center of low pressure inland so still nice steady cooling sea breeze and this pattern with us as quiet mild pattern tomorrow through friday before we start to see changes. overnight tonight again look for fog not only at the coast but locally across the bay for some east bay location up to north bay location. low pressure will be in rather narrow range overnight tonight. mid 50's. not much variation there. animation 5:00 o'clock tomorrow morning we still have some fog then we have locally inland and burn back to the coast and away from the coast and much like today, tomorrow sunny skies from coast to inland. high pressure ranging from 60's near the coast and 70's right around the bay to maybe low to mid 80's in the warmest inland location. let's start with the south bay. sunny and mild. see high of 79 at san jose. 79 in cupertino up to 80 at campbell. on the peninsula 72.

snapper but what you are getting is something very different. abc news reporter with new investigation tonight of fish fraud. >> that first bite of grouper takes fishy. that's because it's raw for dipper. a conservation group sampled 61 florida seafood business finding 1 in 3 chance of bait and switch. instead of the prime fillet of fish you get another cheaper fish. >> red snapper is almost always substituted for something else. almost always substituted for something else. 80 percent of the time. >>reporter: he has been testing fish for years. >> out and out consumer fraud. not get what they paid for and health risk because substitute are often contaminated with pollutant. >>reporter: florida is just the beginning. 48 percent of the fish are mislabeled and in lvl a 55 percent. being listed here doesn't help. >> we found substitution in expensive restaurants as well

student of the month at 62. everybody at school is beaming from the principal on down. >>reporter: the couple not only adopted josh but adopted 4 other foster children because they were siblings and didn't want to break up the family. >> i think it helped that both of us come from large families. because we are used to the okay. it's chaos. it's chaos sometimes. >>reporter: they first became foster parents through non-profit called spirit net. organization is dedicated to encouraging more people to become foster parents and improving the lives of foster children. early 60,000 children living in foster care in california. richard and steven weather know firsthand what it is like to need a place to call home. >> my parents weren't able to be there for me when i was younger. and while growing up in foster care system i experienced good times and bad times. i was in 12 different homes.
